New Delhi: Expressing concern over delays Meeting In various tribunals Supreme Court The Center has directed to complete the appointment of four judicial members in the Railway Claims Tribunal immediately Appointment Committee of the Council of Ministers.
A bench headed Justice L Nageshwar Rao said, but the tenure of such members will be subject to the outcome of the pendency in the case.
Top Court The judge was hearing a petition filed by the Bar Association, Railway Claims Tribune, Jaipur. Judicial members of the tribunal were demanded to fill the vacancies.
The apex court noted that on April 2, 2020, the Center had submitted that the process of appointment of one member to the tribunal would be completed within 15 days.
On June 15, 2020, technical members were appointed. However, the appointment of judicial members was stopped.
When the issue was raised in December, 2020, the Center assured the court that the appointment to the post of Judicial Member would take effect soon.
Senior Advocate Nikhil Nayyar, in favor of the petitioner, informed the proceedings on October 21, 2020 that the Appointments Committee of the Council of Ministers has approved the proposal to appoint four judicial members in the tribunal.
He argued that there was no reason not to appoint people whose appointments had been approved.
Attorney General KK Venugopal told the court that the court’s decision would limit the term to years due to delays in appointments. Ordinance April 2021 sets the term of office of members at four years.
The bench of Justice Hemant Gupta and Justice S Rabindra Bhatt also said, β€œThe appointment of four judicial members will be made immediately as approved by the Appointments Committee of the Council of Ministers on October 21, 2020. The tenure of such members will result in a written petition filed by the Madras Bar Association, scheduled for a final hearing on May 1, 2021. ”
The case is scheduled to be heard in two weeks.
